The Civil Rights Committee, chaired by Mari Newman, will host a meeting Thursday, August 31, 2023,at the CTLA office starting at 12pm.. We encourage you to attend in person, but a Zoom option is available.
The first trial in Colorado under C.R.S. 13-21-131 raised numerous issues of first impression, including what evidence is admissible in a civil illegal search claim, what constitutes an affirmative defense as opposed to an element of the claim, the proper jury instructions, and the permissible scope of defense expert testimony. It also raised numerous strategic questions, such as what to seek in terms of damages, how to go about witness examinations that alleged police officers were lying, and how to best argue to a jury a question lawyers generally argue solely as a legal issue to a judge. Adam Frank and Cameron Bedard will describe the arguments they made, the court’s rulings, the strategic choices they made, and whether they’d make those same choices again with the benefit of hindsight.
CTLA to apply for 1 CLE credit.
